State legislators in California continue to consider legislation, which we believe would harm dialysis patients by ultimately limiting their access to their life-saving treatment. This legislation, which is being pushed by the labor union, Service Employees International Union, would cut reimbursement rates for patients on private insurance to Medicare/Medi-Cal levels, which are already below the actual cost of care. This will cause many facilities across California to close and leave patients scrambling to find their needed care. The Dialysis De-Funding Campaign is sponsored by two labor unions that seek to represent workers at dialysis clinics. Rather than try to unionize dialysis facility employees through elections, they are trying to punish dialysis providers through policies that cost them financially in order to gain voluntary recognition. On behalf of kidney patients nationally, Dialysis Patient Citizens (DPC) filed a legal complaint with the U.S. Department of Health and Human Services’ Office of Civil Rights citing discriminatory behavior by Blue Cross Idaho (BCI) against individuals with kidney failure, a disease which disproportionately impacts minorities. The complaint involves a new BCI policy guideline, targeting policyholders with kidney failure who need three times weekly dialysis to live. CMS to Expand Prior Authorization of Transportation Services to Six More States

The Centers for Medicare and Medicaid Services (CMS) will begin expanding a prior authorization model for non-emergency ambulance transportation for dialysis patients into six states: Maryland, Delaware, the District of Columbia, North Carolina, Virginia and West Virginia. The program expansion will begin on January 1, 2016 and requires ambulance providers in those states to obtain documentation from physicians prior to beginning service. CMS plans to reach out to ambulance providers and Medicare beneficiaries about the program through educational materials. DPC and kidney advocates won a ruling from the Oregon insurance commissioner against discriminatory language in an insurance policy limiting coverage for ESRD patients. Bob Lee, a DPC Patient Ambassador and ESRD patient, and Hrant Jamgochian, Executive Director of DPC, attended a public hearing on the topic in Salem and presented testimony on behalf of DPC’s membership.
