Dialysis Patient Citizens Celebrates Virginia Legislation Guaranteeing Medigap Access

(March 24, 2023) -- Dialysis Patient Citizens (DPC) today celebrates Governor Glenn Youngkin’s (R) signing of Virginia bills SB 1409 and HB 1640 into law, guaranteeing access to affordable Medigap coverage for thousands of Virginians under 65 living with end-stage renal disease (ESRD). 2023 State Advocacy Kick-Off

It’s been a busy start in 2023 for DPC’s state advocacy efforts. Bills impacting dialysis patients are being introduced in multiple state legislatures and moving quickly through the legislative process. Legislation to expand Medigap access has already been introduced in Hawaii, Indiana, Kentucky, Nebraska, and Virginia. Improving Medigap access is a top policy priority for DPC, and we are pleased that multiple states are considering how they can expand access to Medigap plans, particularly in states that have limited or no access to Medigap for the under-age 65 End State Renal Disease (ESRD) population. DPC’s comment letter on Medicare’s 2022 ESRD Payment Rule highlighted the impact that labor shortages may have on dialysis patients. “Currently, there are nearly two job openings for every available unemployed worker. Vulnerable patients need a labor market in which there is a one-to-one ratio of health care workers for vacancies in essential jobs. Over the long term, the government may need to act to foster interest among young people in healthcare careers and facilitate their preparation for such roles. Rhode Island Medigap Legislation Signed by Governor McKee

On June 30,2022, Rhode Island Governor Dan McKee signed into law H. 7244 and S. 2194, which provide guaranteed issue access to Medicare Supplement Insurance coverage – known as Medigap – for under age 65 residents with End Stage Renal Disease (ESRD) and qualified disabled. The legislation becomes effective July 1, 2023. The new law also provides premium protections through the premium rate review process of the Office of the State Health Insurance Commissioner.
