CMS Announces Penalties and Rewards for Promoting Home Dialysis and Transplants

On September 18, the Centers for Medicare & Medicaid Services (CMS) announced it finalized the End-Stage Renal Disease Treatment Choices (ETC) Model. The ETC Model was a cornerstone of President Trump’s Advancing Kidney Health Executive Order in 2019. It encourages an increased use of home dialysis and kidney transplants in approximately 30 percent of dialysis facilities and nephrology practices and will be implemented on January 1, 2021. CMS estimated reduced expenditures of $23 million over five and a half years, anticipating that providers assigned to the program will be penalized for not meeting standards. As temperatures cool and the California legislature winds down from a flurry of late summer activity, two bills that would impact kidney disease patients recently landed on Governor Newsom’s desk for his signature or veto. In response to the Administration's announcement to improve kidney health in America, the Centers for Medicare and Medicaid Services (CMS) proposed a rule to implement a mandatory Medicare payment model designed to increase the number of home dialysis treatments and kidney transplants, all while reducing Medicare expenditures. The rule—referred to as the End-Stage Renal Disease (ESRD) Treatment Choices Model (ETC Model)—would measure clinician and facility performance, as well as the rate of home dialysis and kidney transplants in selected geographic regions. The US Department of Labor's Wage and Hour Division published an opinion letter last week stating that surgery for people who donate an organ qualifies as a “serious health condition” under the Family and Medical Leave Act (FMLA). The letter may provide reassurance to individuals that are considering donating a kidney, but are concerned about losing their jobs due to being away for surgery or post-surgery care. On February 25, Congressman Jerrold Nadler (D-NY) and Congressman Michael Burgess M.D. (R-TX), joined by Senator Kirsten Gillibrand (D-NY) and Senator Mark Kirk (R-IL), introduced the Living Donor Protection Act of 2016 to protect the rights of living organ donors. The Family and Medical Leave Act (FMLA) does not specify that living organ donors can take unpaid leave to recover from their donation and does not guarantee that donors will have a job waiting for them after surgery.
